This applies both to cases where thefood.pl s.c. processes personal data obtained directly from the data subject, as well as cases where we have obtained personal data from other sources.

3. For what purpose and on what basis do we process personal data?

Here’s the English translation:

The personal data obtained from you is used for the following purposes, depending on the situation in which we gained access to it:

  • Conclusion and performance of the contract between you and thefood.pl s.c., including the handling of any complaints;
  • Fulfillment of legal obligations incumbent on thefood.pl s.c. arising from legal provisions, e.g., issuing and storing invoices and accounting documents, fulfilling obligations regarding the security of services provided;
  • Establishment, defense and pursuit of potential claims, which may include the sale of receivables to another entity, i.e., in the legitimate interest of thefood.pl s.c.;
  • Direct marketing of thefood.pl s.c. services, i.e., in the legitimate interest of thefood.pl s.c.;
  • Creation of reports, analyses and statistics for internal purposes of thefood.pl s.c., including in particular reporting, marketing research, ad targeting, remarketing, planning service development, development work in IT systems, creating statistical models, evaluating the functioning of the thefood.pl s.c. website, including viewership statistics of subpages.

Your personal data will not be used for purposes other than those indicated here, unless thefood.pl s.c. obtains your consent or another use of this information is required or permitted by law.

  • Fulfillment of a legal obligation incumbent on thefood.pl s.c. – the legal basis is this legal obligation (Art. 6(1)(c) GDPR);
  • Purposes arising from legitimate interests pursued by thefood.pl s.c., i.e., for direct marketing of our services, fraud prevention or pursuing and defending claims – the legal basis is the legitimate interest of thefood.pl s.c. or our clients (Art. 6(1)(f) GDPR).

If our use of your data is not necessary for contract performance, fulfillment of a legal obligation or does not constitute our legitimate interest, we may ask for your consent for specific uses of your data (Art. 6(1)(a) GDPR). You may withdraw your consent at any time, but this will not affect the legality of our previous use of your data.

Providing your personal data is not mandatory, however, failure to provide it will result in thefood.pl s.c. being unable to perform actions for which the data is required.

In accordance with the established practice of most websites, we store HTTP queries directed to our server. Browsed resources are identified by URL addresses. The exact list of information stored in the web server log files is as follows:

      • Public IP address of the computer from which the query came (this may be directly the user’s computer)
      • Name of the user’s station – identification carried out by the HTTP protocol if possible,
      • Username provided in the authorization process,
      • Time of query arrival,
      • First line of the HTTP request,
      • HTTP response code,
      • Number of bytes sent by the server,
      • URL address of the page previously visited by the user (referer link) – in case the transition to our site occurred through a link,
      • Information about the user’s browser,
      • Information about errors that occurred during the HTTP transaction.

6. Cookies

7. How long do we store personal data?

thefood.pl s.c. will process your personal data for no longer than is necessary to achieve the intended purposes, namely:

  • For the time necessary to conclude and perform the contract between us and the period after which claims arising from this contract become time-barred;
  • For the duration of fulfilling our legal obligations, and then for the period in which we may face legal consequences for non-compliance with the obligation, e.g., state authorities may impose a financial penalty on us;
  • In case thefood.pl s.c. processes personal data based on consent – until it is withdrawn;
  • In case thefood.pl s.c. processes personal data based on the legitimate interest of the data controller – until such interest ceases (e.g., expiration of the limitation period for civil law claims) or until the data subject objects to further processing (in situations where, according to legal provisions, such objection is available);
  • In case of direct marketing of our services – until an objection is raised by the data subject;
  • In the absence of specific legal or contractual requirements, the basic data retention period for records and other evidence documentation created during contract performance is a maximum of 10 years.

thefood.pl s.c. may disclose selected information about you to appropriate public authorities (including law enforcement agencies) or third parties when required by applicable laws, other legal provisions or court judgments. The need to disclose personal data may also be caused by conducting audits in the field of data privacy or security or when handling complaints or taking action related to security threats.

9. Rights related to the processing of personal data

In connection with the processing of your personal data by thefood.pl s.c., you have the following rights:

  • The right to access your data and receive a copy of it (which is limited to data processed on the basis of a contract or consent and in an automated manner);
  • The right to rectify (correct) your data;
  • The right to erasure of personal data, in situations where data processing is not carried out to fulfill an obligation arising from legal provisions;
  • The right to restrict data processing;
  • Regardless of the above rights, you have the right to object to the processing of your data based on our legitimate interest, including for direct marketing purposes.

You also have the right to lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office in Warsaw (at the address: Personal Data Protection Office, ul.
